Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you and LicensedGunStoresNearMe.com ("LicensedGunStoresNearMe", "we", "our", or "us") governing your access to and use of our website, applications, APIs, and related services (collectively, the "Service"). Please read them carefully. By accessing or using the Service, by submitting an customer inquiry, by creating an account, by claiming or self-creating a business listing, or by purchasing any subscription, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

1. What we are -- and what we are not

LicensedGunStoresNearMe.com is a U.S. directory and lead-referral platform that connects customers with licensed gun stores, firearms dealers, FFL holders, shooting ranges, gunsmiths, and adjacent firearms-industry professionals.

We are NOT a gun store, NFA compliance contractor, ammunition professional, medical authority, or licensed gunsmithing firm. We do not perform services, testing, sampling, abatement, gunsmithing, or any other physical work at any property. We do not give medical, legal, real-estate, or environmental-engineering advice. We are not affiliated with, sponsored by, endorsed by, or the agent of any business listed on the Service unless explicitly stated in writing.

2. Eligibility

You must be at least 18 years old (or the age of majority in your state) to use the Service. If you use the Service on behalf of a business or organization, you represent and warrant that you have authority to bind that entity to these Terms.

3. Accounts

• You are responsible for keeping your account credentials secure and for all activity that occurs under your account.
• You must provide accurate, current, and complete information when creating or updating an account, claiming a listing, or submitting an customer inquiry.
• You may not impersonate any person or business, register on behalf of someone else without authorization, or use an email address belonging to someone else without their permission.
• We may suspend or terminate any account at our discretion for violations of these Terms, suspected fraud, abuse of the lead system, or non-payment of subscription fees.

4. Service requests (customers)

When you submit an "Customer Inquiry" or similar form through the Service, you authorize LicensedGunStoresNearMe to share your name, email address, phone number, ZIP/city/state, property type, urgency, preferred contact method, and free-text inquiry with a small set of contractors (typically 1-8) we determine are best positioned to serve you. Submission of the form requires explicit consent via the consent checkbox.

We make no representation, warranty, or guarantee that any listed contractor will respond, accept your job, be qualified, be licensed in your jurisdiction, be insured, be available within any particular timeframe, or perform any work to any particular standard. Independent verification of credentials, licensing, insurance, bonding, and references is your responsibility before engaging any contractor.

5. Business listings

5.1 Unclaimed listings

Many listings on the Service are seeded from public professional registries, license boards, and industry certificant directories (see our Data Sources page for the complete list). These "Unclaimed" listings carry only factual public information -- business name, address, phone, license number, certification name, jurisdiction. They are marked "Unclaimed" until the actual business owner registers and claims them.

If you are the owner of an Unclaimed listing and want it removed, edited, or claimed, you can submit a claim through the listing's public page or email us at gunshopnearme@hotmail.com. Verified removal requests are honored within 7 business days.

5.2 Claimed listings (Free tier)

When you claim a listing or self-create a new listing through the "Get Listed" flow, after our verification process you receive a free Claimed listing that includes:

• Business name, address, phone, and primary contact email
• Logo upload
• Unlimited service-area cities and ZIP codes
• Unlimited services from our service taxonomy
• Removal of the "Unverified" badge once verification is complete
• Eligibility to receive matched leads

5.3 Preferred Vendor (paid tier)

For $30 USD per month, billed via Stripe, the Preferred Vendor tier adds:

• Silver-bordered listing card and Preferred Vendor badge
• Top placement in search results and city directories
• First-priority lead routing within the same service category and location
• Website URL and social media links
• A short business description you can edit at any time
• Up to 5 photos uploaded to your profile

To purchase a Preferred Vendor subscription, you must first have a free Claimed listing. Subscriptions auto-renew monthly until you cancel through the billing portal in your business dashboard. Cancellation takes effect at the end of the current paid period; you will retain Preferred Vendor benefits through the end of the period for which you have already paid.

5.4 Listing accuracy and content responsibility

• You are solely responsible for the accuracy, legality, and appropriateness of all content you publish on your listing (description, photos, services, areas served, social links, etc.).
• You may not list services for which you are not legally authorized to perform in the jurisdictions you cover.
• You may not upload photos you do not own or are not licensed to use.
• We may verify, edit, refuse, suspend, downgrade, or remove any listing at our discretion at any time, including but not limited to listings that contain misleading claims, expired licenses, consumer complaints we determine to be substantiated, or violations of these Terms.
• Verification badges ("Verified", "Claimed", "Preferred Vendor") reflect the information submitted to us and the tier purchased. They are not endorsements, recommendations, or guarantees of quality.

6. Lead referrals to contractors

If you are a contractor receiving leads through the Service, you agree to:

• Use the customer contact information shared with you solely to respond to that specific inquiry. You may not add it to a marketing list, sell it, share it with third parties, or use it for any other purpose.
• Honor the customer's preferred contact method when first reaching out.
• Not impersonate LicensedGunStoresNearMe in your communications, and not represent yourself as our agent, employee, or partner.
• Comply with all applicable telephone, email, and SMS marketing laws (TCPA, CAN-SPAM, state equivalents) when contacting any customer.

Repeated complaints, no-response patterns, or evidence of misuse of customer contact information are grounds for suspension of lead routing and/or termination of your account at our discretion, without refund of any prepaid subscription period.

7. Subscription fees, billing, refunds

• Paid subscriptions (Preferred Vendor, $30/month) are processed by Stripe, Inc. under Stripe's own terms.
• Fees are charged in advance at the start of each billing period and are non-refundable except as required by law or as we may choose at our sole discretion.
• We may change subscription pricing on 30 days' notice via email or in-app notice. Changes apply to the next renewal period.
• Failure to keep a valid payment method on file may result in downgrade of your listing to the free Claimed tier.

8. Acceptable use

You agree not to:

• Submit fraudulent, abusive, harassing, or spam content (including fake customer inquirys intended to harvest contractor contact info, or fake reviews intended to manipulate listing rankings).
• Scrape, copy, mirror, or republish any portion of the Service or its content (including listings, photos, descriptions, FAQ content, or compiled directories) without our prior written permission. Public-domain registry data we cite remains available from its original public source.
• Reverse-engineer, decompile, or attempt to extract the underlying algorithms, ranking logic, or matching engine from the Service.
• Use the Service to violate any law, infringe any third party's rights, transmit malware, or interfere with the security or integrity of the Service.
• Circumvent rate limits, bot-protection, or pay-walls.
• Use the Service to send unsolicited bulk communications (spam) to either customers or other contractors.

9. Intellectual property

The Service -- including the design, graphics, logos, brand, software, content (other than user-submitted listing content and public-domain registry data), and the compiled directory itself -- is owned by LicensedGunStoresNearMe and protected by U.S. and international intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose, subject to these Terms.

By submitting content to the Service (listing description, photos, review responses, etc.) you grant us a worldwide, royalty-free, non-exclusive license to host, store, reproduce, modify (for formatting only), publicly display, and distribute that content in connection with operating, marketing, and improving the Service. You retain ownership of your content.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

Without limiting the foregoing, we do not warrant that: (a) the Service will be uninterrupted, error-free, or secure; (b) any listed contractor is properly licensed, insured, or qualified for any particular job; (c) any customer inquiry will receive a response; (d) information sourced from public registries is current as of every minute; or (e) any work performed by a contractor whose listing appeared on the Service will meet any particular standard. You hire contractors at your own risk.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL LICENSEDGUNSTORESNEARME, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR USE, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, WHETHER BASED IN CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF (a) THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (b) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow exclusion of certain warranties or limitation of liability; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless LicensedGunStoresNearMe and its officers, directors, employees, and agents from any third-party claim, damages, liability, loss, or expense (including reasonable attorneys' fees) arising out of or related to (a) your violation of these Terms; (b) your misuse of the Service; (c) your violation of any law or third-party right; (d) any content you submit to the Service; or (e) any work performed by you (if you are a contractor) for any customer connected to you through the Service.

13. Termination

You may close your account at any time through your dashboard or by emailing us. We may suspend or terminate your access to all or part of the Service immediately, with or without notice, for any reason including breach of these Terms, suspected fraud, non-payment, or regulatory requirement. On termination, the licenses you have granted to us survive only as needed for legal record-keeping; public-facing user content will be removed within 60 days.

14. Governing law and disputes

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict-of-law principles. The federal and state courts located in Cook County, Illinois have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to the personal jurisdiction of those courts.

Before filing any claim, you agree to first contact us at gunshopnearme@hotmail.com to attempt informal resolution. We will respond within 30 days.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date at the top and, where appropriate, notify you by email or via a notice on the Service. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

16. Miscellaneous

• Entire agreement: These Terms together with our Privacy Policy constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
• Severability: If any provision is held unenforceable, the remainder of the Terms will remain in effect.
• No waiver: Our failure to enforce a provision is not a waiver of our right to enforce it later.
• Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms to a successor in connection with a merger, acquisition, or sale.
• Independent contractors: No agency, partnership, employment, or joint-venture relationship is created by these Terms.
• Force majeure: We are not liable for delays or failures resulting from causes beyond our reasonable control.
